TMZ has released an audio recording where a voice identified as Donald Sterling, owner of the LA Clippers, is making highly offensive remarks about African-Americans to his then-girlfriend V. Stiviano. The Comments He are some of the comments attributed to Sterling on the recording: - "It bothers me a lot that you want to broadcast that youre associating with black people. Do you have to?" - "You can sleep with [black people]. You can bring them in, you can do whatever you want. The little I ask you is not to promote it on that ... and not to bring them to my games." - "Im just saying, in your lousy (expletive) Instagram, you dont have to have yourself with, walking with black people." - "...Dont put him [Magic] on an Instagram for the world to have to see so they have to call me. And dont bring him to my games." League Responds NBA Commissioner Adam Silver has expressed profound disappointment over the comments and has urged the public to allow for due process to run its course before any action is taken. "All members of the NBA family should be afforded due process and a fair opportunity to present their side of any controversy," Mr. Silver said, "which is why Im not yet prepared to discuss any potential sanctions against Donald Sterling. We will, however, move extraordinarily quickly in our investigation." The Clippers have declared that these comments do not reflect the views of Sterling and that they are looking into the issue. The public was also reminded that the source of the recording, Stiviano, is being sued by Sterlings wife for embezzling $1.8 million in the form of cash, cars and other items from the Clippers owner, thereby suggesting that the veracity of the recording should be questioned. Investigation The first step for the NBA is authenticating the recording. That means confirming that the voice on the recording is that of Sterling and that the recording was not doctored. Sterling may admit that the voice is his, but allege that his ex-girlfriend doctored the tape as payback for being sued by the Clippers owner. Authenticating the recording may not be an easy process. The NBA will need to get Stiviano to agree to be interviewed (likely under oath), which she may decline. If she refuses to talk to the league, there is little it can do to force her since the NBA does not have subpoena power (or an ability to force Stiviano to submit to an interview). The NBA could also hire an expert to review the recording to assess the likelihood that it has been tampered with and whether the voice is that of Sterling. The NBA is being criticized for not suspending Sterling pending the outcome of the investigation. While the sentiment is understandable, the NBA is bang on here. It is important to observe the principles of fundamental justice, which include that justice be administered fairly. A person is entitled to a fair shake even in the face of despicable comments. The NBA is proceeding with its investigation expeditiously and is aiming to have it done in a "few days". Until then, it is important, if not critical, that the process be respected. Fines, Suspensions and Sale of Team Some people around the league want Sterling gone permanently given his a history of being racially insensitive. In 2009, Sterling was sued for discriminatory housing practices after being accused of seeking to drive African-Americans and Latinos from his apartment buildings. The billionaire settled the lawsuit by paying $2.725 million. He was also sued by his former GM Elgin Baylor, who filed a wrongful termination lawsuit that included allegations of racism. In part, Baylor alleged that Sterling rejected a coach because he was African-American. While some want Sterling gone, the NBA is unlikely to force Sterling to sell the team. If the league tried, they would likely be sued by Sterling, who in part, would allege that the league is violating antitrust laws. If successful, such a lawsuit could get Sterling a massive payout. A more likely scenario is a long suspension. And there is a precedent for that: former Cincinnati Reds owner Marge Schott. In December 1992, Schott was quoted in the New York Times as saying that her use of the N-word was a joke after referring to Eric Davis and Dave Parker as her "million-dollar n------". In that same interview, she made favourable comments about Adolf Hitler. As a result, MLB suspended Schott for one year. In 1996, she was suspended for another two years after more racially insensitive comments. In 1998, with her health failing, she agreed to sell the team. Apart from a suspension, we could also see a substantial fine. Ultimately, a fine of $1 million to $5 million would not be surprise. If authenticated, the comments are of course completely unacceptable, highly offensive and frankly disturbing. As well, according to a recent report, African-Americans comprise 76 per cent of all NBA players, while 81 per cent of players are of colour. So the NBA knows one thing: it has to get this right. After winning Sundays Heritage Classic game in Vancouver, there is a sense that perhaps the Senators can use that victory as a springboard down the stretch. One would think that winning one of the NHLs signature events – with 50,000 fans watching in the stadium and a larger-than-normal television audience – could propel this team onto a much-needed winning streak. But looking at the brief history of these events, there is hardly any connection between winning an outdoor game and any subsequent success in the NHL. A few years ago, the 2008 Penguins and the 2009 Red Wings each made it to the Stanley Cup Final in the same year after winning the Winter Classic game – although that was more likely the result of having a powerhouse lineup than anything to do with playing in an outdoor game. For the Senators, a better comparable would be to look at some of the less dominant teams that have won an outdoor game and how that affected them immediately afterwards. This season, for example, the Toronto Maple Leafs won the Winter Classic in Ann Arbor – but then turned around and lost their next four games. In 2011, the Calgary Flames beat the Montreal Canadiens 4-0 in the Heritage Classic at McMahon Stadium. The Flames ended up losing three of their next five games, so any momentum they gained from winning the outdoor game was non-existent. The same can be said for the 2003-04 Montreal Canadiens, who beat the Edmonton Oilers in the first-ever outdoor game at Commonwealth Stadium. The Habs managed to win only two of their next five games – although they did manage a pair of ties as well. Manning, the former Kansas star who spent the past two seasons coaching Tulsa, was hired Friday as Wake Forests basketball coach. Hell be introduced at a news conference next week on campus in Winston-Salem, N.C., a short drive from where Manning grew up. The Bengals were shown another early exit, as Marvin Lewis fell to 0-6 in the postseason as Cincinnatis head coach, the last four coming with Andy Dalton under center. Dalton threw for just 155 yards on 18-of-35 passing, but was pressured all game and was without his top two targets in wide receiver A.J. Green and tight end Jermaine Gresham. Harvin had the labrum in his hip repaired and he played in only one regular-season game in 2013. The Rugby Football Union has revealed plans to double the number of women playing rugby in England. As England prepare to defend the womens Rugby World Cup next year, the RFU want to increase the number of women playing the sport from 25,000 to 50,000 by 2021.They also want to double the number of womens fixtures being played, to increase the number of teams by 75 per cent to more than 800, and to increase the number of active womens clubs to more than 400. New York Islanders defenceman Travis Hamonic has been suspended for one game for instigating a fight during the final five minutes of Saturdays game against the New Jersey Devils. Islanders coach Jack Capuano was also fined $10,000 for his role in the incident. The National Hockey Leagues Department of Player Safety announced the penalties on Saturday. Hamonic was given a minor penalty for instigating, a major penalty for fighting and a game misconduct on the play, which occurred at the 15:23 mark of the third period. Hamonic was attempting to fight Devils forward Ryan Carter, who did not respond to Hamonics actions. In 49 games this season, Hamonic has one goal and nine assists. REGINA -- Some children skipped school and adults did the same with work to join the crowd at a Grey Cup parade in Regina on Tuesday. The parade and rally were held to celebrate the Saskatchewan Roughriders 45-23 win over the Hamilton Tiger-Cats on Sunday in the CFLs championship game. Flatbed trucks carried players from Mosaic Stadium through part of downtown Regina that has been dubbed the "Green Mile" to the Saskatchewan legislature. Fans dressed in green and white cheered along the route, then followed the players to the rally at the provincial legislature. The biggest cheers were for Riders head coach Corey Chamblin, quarterback Darian Durant and running back Kory Sheets. "Lets go Riders," Chamblin shouted when he stepped up to the microphone at the rally, and the crowd echoed back. "I love it," said Chamblin. "This is a special place, with special people, with a special team and we deserve the cup. On behalf of the premier and the mayor, we all have the month of December off." AUGUSTA, Ga. - Billy Horschel won the Zurich Classic two weeks after the Masters last year, and thus became first on the list of players who earned their first trip to Augusta National. He just had no idea how long the list would grow. Derek Ernst won at Quail Hollow. Harris English won in Memphis. Throw in the six amateurs, and then cap it off with Matt Jones being the last man in by winning the Shell Houston Open. The final tally is a record 24 players who will be making their debut at the Masters this year. This is the 78th Masters, and only three players have won on their maiden voyage around this pristine golf course. Horton Smith won the first one in 1934. Gene Sarazen won the following year. It then took 45 years to get another Masters rookie in a green jacket — Fuzzy Zoeller in 1979. There hasnt been another one since, although the odds have never been better. Nearly 25 per cent of the field is at the Masters for the first time. Smith gets overlooked as a "Masters rookie," and rightly so. All 72 players were rookies that year. Here are the best five performances by players at Augusta National for the first time: 5. JASON DAY: He qualified for his first Masters by winning the Byron Nelson Championship for his first PGA Tour victory. The 23-year-old Australian was loaded with far more talent than victories to show for it, but he took a liking to a course that had never produced a champion from Down Under. Day shot an 8-under 64 in the second round to get within two shots of the lead, and the only reason he didnt get more attention was because 21-year-old Rory McIlroy was ahead of him. And they played in the same group, along with 22-year-old Rickie Fowler. This was in 2011, the year McIlroy lost a four-shot lead with an 80 in the final round. Day hung around to the very end, and when he finished with a birdie for a 68, he was tied for the clubhouse lead with Adam Scott. Behind them was Charl Schwartzel, who took the outright lead with a birdie on the 17th and rolled in his fourth straight birdie on the final hole for a two-shot win. Day went home with a silver medal as a runner-up in his debut. 4. HUSTON, WE HAVE A PROBLEM: John Huston became known as the most feared player in golf — on Tuesday in money games with the pros. He won seven times on the PGA Tour, the first won coming in 1990 that made him eligible for his first Masters. He opened with a 66, leaving him two shots behind Mike Donald. And while he followed with a 74 in the second round, he still trailed by only two shots. Huston had a 68 in the third round to stay within two shots of former Masters champion Raymond Floyd. Better yet, he was in the final group, giving him an excellent chance to become the first Masters rookie to win since Zoeller. Alas, Huston fell back with a 75 on the final round. The winner came from back in the pack — Nick Faldo made up four shots on Floyd with six holes to play, and then won on the second extra hole when Floyd hit into the water on No. 11. Huston tied for third in his debut. He played the Masters 12 more times and never had a higher finish. 3. POHLS CLOSE CALL: Dan Pohl made an inauspicious debut in 1982 when he opened with a pair of 75s. That would have missed the cut at most other Masters, but not this one. Conditions were tough by rain the opening two days, leading to the highest cut (10-over 154) in Masters history. He was still six shots behind. Pohl, the longest hitter on tour, followed with a 67 on Saturday on the strength of back-to-back eagles on the 13th and 14th holes, though he still was six shots out of the lead. And even with the low score of the final round — another 67 — it didnt appear to do much good. Craig Stadler was six shots ahead going to the back nine until the Walrus started dropping shots. Stadler wound up with a 73, and suddenly Pohl was in a sudden-death playoff. It didnt last long. Pohl missed a 6-foot par putt on the first playoff hole at No. 10, and Stadler made par to win. Pohl had to settle for silver. 2. THE SHOT HEARD ROUND THE WORLD: Gene Sarazen hit the shot that put the Masters on the map and won at Augusta National in his first try. But being a "rookie" at the Masters wasnt that big of a deal. The Augusta National Invitation Tournament was only in its second year. Sarazen missed the inaugural event, and this "rookie" had already won six majors, the first of them 13 years earlier. Still, what he did that day cannot be overlooked and will not be forgotten. Trailing by three shots, he hit 4-wood into the hole for an albatross on the par-5 15th hole to force a playoff with Craig Wood. In the only 36-hole playoff in Masters history, Sarazen shot even-par 144 to win by five. He remains the only player to complete the career Grand Slam at Augusta National. 1. FUZZYS FIRST MAJOR: Zoeller whistled his way into the record books as the first major champion to win a sudden-death playoff. The Masters went away from the traditional 18-hole playoff in 1979, and it turned out to be memorable. Much like Pohl, Zoeller was never really in the picture until someones misfortune on the back nine. Zoeller was six shots behind going into the last round and closed with a 70. It looked like it would be a good debut at the Masters, nothing more. That was before Ed Sneed, who had a three-shot lead with three holes to play, finished with three bogeys. That led to a three-man playoff among Sneed, Zoeller and former Masters champion Tom Watson. On the second playoff hole, Zoeller knocked in a birdie putt and leapt into the air to celebrate. WINNIPEG -- Winnipeg Jets forward Evander Kane says he did throw three punches, but only in defence, as he was attacked in Vancouver by a man now suing him for assault. Vancouver resident Lev Makievsky has said he was returning home from work Aug. 10, 2013, in the downtown area when he was assaulted by Kane, who is from Vancouver. His statement of claim gave no details of the alleged incident but listed a long series of injuries he says he incurred, including a concussion and an unnamed permanent physical disability. Kanes lawyers have filed a response that says he has known Makievsky for about four years and encountered him at about 2 a.m. on the date in question. It says Makievsky tried to get Kane to fight and when he declined, charged and swung at Kane, who responded with three punches and knocked his attacker down. Then, as Makievsky got up and swung again, Kane pushed him down and left. "The Plaintiff was highly confrontational and shouted insults at the Defendant," says Kanes response filed in the Supreme Court of British Columbia. "When the Defendant attempted to walk away, the Plaintiff said lets go and suggested that the Defendant should engage in a physical fight with him." The response also says Makievsky was heard boasting at work the next night that he planned to sue Kane. "The Defendants conduct was at all times consistent with preventing or repelling the Plaintiff from attacking him. The Defendant used no more than reasonable force to defend himself from the Plaintiff." Kanes response notes no charges have been laid.
